APPLICABLE REGULATIONS
This electronic contract is entered into in compliance with Spanish regulations and specifically under the legal regime imposed by Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE) and by Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users (TRLDCU). The electronic contract is presented to the consumer in Spanish.
These General Terms and Conditions of Contract may be saved and reproduced at any time by the User who makes a purchase through the options of their internet browser, and must be accepted before proceeding with the payment of the products. Likewise, in the purchase confirmation email that we send you, we will include the link to these General Terms and Conditions of Contract.
PURCHASE PROCESS
To make a purchase in redverde.es the User must follow the following process:
- Select the products you wish to purchase from among those offered by RedVerde on its website.
- Once you have selected the product(s) you wish to buy, you must press the “Add to Cart” button, and the product will be added to your shopping cart. If you wish, you can continue to add more products to your shopping cart.
- During the purchase process, you can identify yourself with your User account details or fill in the registration form if you are not yet a Registered User. If you prefer, you can go through the checkout process as a guest, without registering. However, in cases where the purchase has an amount equal to or greater than 3,000 euros, the inclusion of tax data is required, in compliance with the regulations applicable to the invoicing process.
- Finally, you must choose the payment system for your order among those offered by RedVerde on its website. Some means of payment such as PayPal are managed by the company that owns this means of payment, so RedVerde declines any type of responsibility for problems arising from the use of these systems or platforms outside of RedVerde.
- Once the order process is completed, RedVerde will send you an email detailing the details of your order. If you do not receive this email within 24 hours, please contact us. If you notice any errors in the data entered in your order, you can correct them through the following means:

SHIPPING COSTS
At RedVerde we ship to mainland Spain, the Balearic Islands and mainland Portugal.
The shipping cost is automatically calculated based on the total weight of the order and the destination area. There are two modes of transport: standard shipping and palletized shipping. In some weight ranges, the customer will be able to choose the modality they prefer during the purchase process.
If you live in the province of Malaga, you can select the option of in-store pick-up, completely free of charge. This option will be displayed during the checkout process if your address is within the province.
All prices listed below are exclusive of VAT. The corresponding VAT will be added during the purchase process.

DELIVERY TIMES
Orders are processed within 24 hours of receipt of payment. Orders received after 3:00 p.m. on Fridays will be processed on Monday.
Once processed, orders shipped within the peninsula usually arrive within 4 business days. Orders to the Islands, due to the uniqueness of sea shipping, can be delayed up to 15 business days.

Sale of products to the Peninsula:
- The RRP (retail price) of items with a shipping address to the Peninsula includes 21% VAT.
RETURNS
At RedVerde we want the User to always be satisfied with our service. As such, we provide several methods for returning an order that may not meet your needs.
Possible cases of return or withdrawal:
The product has a defect or has been damaged during transport:
These products must be returned by the buyer in a way that they are protected, including them inside a box or protective bag. RedVerde will bear all shipping costs for the delivery and return of the product.
RedVerde makes our transport company available to the buyer for the collection of the goods, completely free of charge. If the buyer wishes to return the goods with a transport company other than the one proposed by RedVerde, and the transport company selected by the buyer offers higher rates, the buyer will assume the difference in the transport cost.
When the product has been damaged during transport, we need you to notify us by phone on the same day you receive the goods and to note the incident on the carrier’s delivery note. Likewise, in order to speed up the return procedures, we would appreciate it if you could send us photographs of the damaged item and its packaging, in the part where the damage can be seen, as well as the barcode of the item and labelling of the damaged box.
Before opening the product, we recommend that you verify that the packaging matches the one you requested: (model, color, measurement, finish, etc…), making an immediate claim, in case there is any anomaly. If you detect any anomalies before opening the product, please do not open the seal or packaging of the product.
WITHDRAWAL
In accordance with the provisions of Spanish law, the customer has the Right of Withdrawal, by virtue of which they may return the product received if they find that it does not meet their expectations.
The exercise of this right of withdrawal must be carried out within a maximum period of 14 calendar days from its receipt. In order to exercise this right, the product must be in perfect condition.
The refund of the purchase amount will be made once the condition of the goods has been checked, through the same means of payment used by the buyer and, in any case, within a maximum of 14 calendar days from the reliable receipt of the withdrawal request, as long as it is RedVerde who manages the collection of the item. In the event that the buyer returns the item through a transport company of their choice, the 14-day period will begin to run from the time RedVerde has effective knowledge of the shipment of the goods or, failing that, from the receipt of the item.
The return costs derived from the exercise of the right of withdrawal will be borne by the buyer. To exercise the right of withdrawal, you must notify us at THEKSFACTORY SL, Calle Alcalde Orozco Poada 10. P.I. El Viso. 29006 Málaga. and email address adminstracion@redverde.es, your decision to withdraw from the purchase made, through an unequivocal statement, by letter sent by post, fax or email.
If you have not yet received your order and wish to cancel or modify it, simply inform us of the changes you wish to make, at no cost to you if your order has not yet been processed.

GUARANTEES
Unless proven otherwise, the products will be understood to be in conformity with the contract provided that they meet all the requirements expressed below:
- They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
- They are suitable for the uses to which products of the same type are ordinarily intended.
- They present the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, having regard to the nature of the product.
PROTECTION OF PERSONAL DATA
The personal data collected in the online purchase process will be incorporated into a file owned by THEKSFACTORY SL., for the purpose of processing, sending and invoicing the products purchased. We will only provide the transport and logistics company with the data necessary to send you the products. In this sense, it is reported that in the package sent, your name and surname, delivery address and telephone number will be detailed. The latter information will be included to allow contact between the carrier and the recipient in order to facilitate the delivery process.
In order to place orders in the online shop, each customer will provide, voluntarily and under their own responsibility, their personal data, which must be truthful and accurate. The User who formalises the online purchase process declares to be the owner of the information provided, or failing that, to have the authorisation of the person on whose behalf they carry out the management.
The User may only contract and place orders if they are of legal age. Otherwise, the responsibility for the acquisition of products by minors will be borne by the parents or legal guardians of the minor.
RedVerde does not plan to disclose your personal data beyond cases where:
- An administrative or judicial authority requires us to do so in the exercise of its legally attributed powers.
- There is a regulation with the status of law that establishes this (Public Treasury, in cases of issuance of invoices or purchases whose amount is equal to or greater than 3,000 euros).
- In the case of shipment of the purchased products (the buyer’s data will be provided to the courier, logistics or transport company).
APPLICABLE LAW AND JURISDICTION
This website is governed by Spanish law. The parties submit, for the resolution of any conflicts that may arise, to the courts and tribunals of the User’s domicile.
ONLINE DISPUTE RESOLUTION PLATFORM
The European Commission provides an online dispute resolution platform that is available at the following link: https://ec.europa.eu/consumers/odr/. Consumers will be able to submit their complaints through the online dispute resolution platform.
